(since I found the Final Destiny from your Ishtar Chronicles topic, http://www.rmxpunlimited.net/forums/index....=2274&st=30 ) But I have no idea if you can sue them, I never knew a problem like this could happen. Anyway, since there's proof that you thought up the idea first, you have its rights (or something like that). Basicly what I'm trying to say is, no one can make a game similar (or exactly) like your game without asking you if it's ok to use a few ideas you have used in your game. Jesse66126 4 Report post Posted April 28, 2009 They used Face Maker for the graphics and used the default RPG VX sprites for their main characters,but other than that,the battle system and menu look fairly custom. I found out I can't sue them until they try to profit from the game,THEN I can sue the crap out of them. =) The storyline is like a knock-off from Final Fantasy,SquareEnix will probably be sueing them,too. If you didn't copyright your idea i don't think you can do anything about it and you might lose the court case if you don't have enough evidence and enough people to back you up. You will also need to hire a lawyer(Lots of money) so all in all you might lose more than you make if you win which i say you have a 40% chance of winning. Sorry that's the truth. Try asking at the local library or a given government clerk's office. As for the Final Destiny issue... are you sure that they didn't come up with the name on their own? I mean, "Final" has been around as an element of game titles for longer than many posters here have been alive, and "Destiny" isn't exactly an untouched name element, either. It's quite possible that this is just a coincidence. I mean, I came up with "Eternal Night" quite a while ago, but it's entirely possible that somebody else might, through sheer chance, with no intent of borrowing a single idea or concept of mine, use the name too, perhaps for an entirely different game. The real sign of a rip-off is if they're stealing the story, the characters, the systems, something like that. Name alone isn't that big a deal. Share this post Link to post Share on other sites

I hate it so much because it's so flexible it can literally cover everything. For instance, you owe Warner Brothers a royalty fee if you had your employees sing Happy Birthday for customers in the restaurant business. It's total garbage. I'd be surprised if similar laws don't exist in other countries, though-- remember, "Happy Birthday" will only get you in trouble if you have an official business thing for singing it, or put out a recording of it-- not for just singing it at a birthday party.
