laansolo 3 Report post Posted October 23, 2010 I heard a story a long time ago, and it went like this: A family dies in a car crash because the breaks failed in just that one car. They were then sued and the car of that type were all recalled. 2,000 people die from poisons, bugs, and various disgusting things in most resturaunts, and the resturaunts get off scot-free. Now, how fair is that? I would like to hear your oppinion.
Marked 197 Report post Posted October 23, 2010 It's not fair at all. But, if all the cars were recalled, then clearly something was wrong with them. You don't recall an entire model of cars on suspicion or by one accident. Secondly, I only know about the US regarding this, but the ability to sue people for person damage is stupid. That is, getting injured in an accident. In NZ if you get injured in an accident you can't sue the person who caused it, because we have ACC(Accident Compensation Corporation). provides comprehensive, no-fault personal injury cover for all New Zealand residents and visitors to New Zealand. laansolo 3 Report post Posted October 23, 2010 Well, yah, but i just dont think its fair that 4 people died in 1 car accident and 2,000 die because of some resturants. There was a story where a taco bell worker put his own excrement in the beans, and a lot of people got sick, and quite a few died. All that happened was taco bell fired the guy, and had to pay (I think could be more) 60,000 in fees. It's not fair at all. But, if all the cars were recalled, then clearly something was wrong with them. You don't recall an entire model of cars on suspicion or by one accident. Ya, but it was just that one car, and thay all got recalled. It's not like with the Toyota's that their brakes failed on ALL of them, just that singular case. It was one of Fords SUVs, too. And Ford usually doesnt have anything wrong with their cars. I'm not saying you are wrong, but probably the main reason why they recalled all those cars is because of that one accident, and they didnt want to risk getting sued again. Leophard 0 Report post Posted October 23, 2010 My guess is that in the restaurant's case, there is rarely any specific proof that the restaurant caused it. It's quite easy to get something weird in your food which makes you go ill or even die, especially in crowded places such as a restaurant. For instance, if you got sick from eating at a restaurant, you wouldn't know which specific thing made you sick - Did the cook do something wrong? Did somebody ill or infected come near your food? Or did they simpily use an ingredient which you happened to be allergic against? Not to mention that food takes some time to digest, which means that the bacteria need some time to get into your bloodstream, which in turn makes it even harder to find where it came from. In the car company's case however, it can be clearly seen what caused it. Even in completely wrecked cars, it's often not very hard for most experts to see what caused the car to crash. In other words, there actually is specific proof that the car company caused it. Regardless though, considering the nature of the story, I'm guessing that this thing happened in America. I don't want to sound discriminatory, but practically everybody sues everyone and everything in there, so I would not be surprised about this.
Marked 197 Report post Posted October 23, 2010 To believe the story I'm going to need to see some specific new article or something... A company just wouldn't do it without checking other models. Some things happen to specific cars, they need proof that it is an issue with all the models. You are implying that they did based solely on that one accident, which doesn't seem realistic to me. As for the restaurants, can they be held liable if it can proven beyond reasonable doubt they caused the death?

I haven't found it yet. I suppose the restaurant cant be liable if the customer chose to eat their food unless the people at the restaurant purposely put stuff in it. The dude probably thought it was a good idea to actually eat Taco Bell "food" and saw that the line for the bathroom was long. He did probably the only thing that was even slightly sensible: add it to the food. It's not like anyone was going to notice.
